1. Acceptance of Terms & License Grant
By downloading, installing, or using Cactus Watch (“the App”), provided by Cactus Watch (“we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.
Your use of the App is also subject to our Privacy Policy, which describes how we collect, use, and protect information related to the App.
- License Grant: Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App solely for your personal, non-commercial, informational use.
2. Subscription Services & Billing
The App offers free features and premium subscription tiers. All purchases, payments, and subscriptions are handled entirely and securely by the Apple App Store and Google Play Store.
- No Accounts or User Data: The App does not support user accounts, profiles, or user-generated content.
- Payment Processing: We do not collect, store, or have access to any financial details, credit cards, or billing transaction history.
- Subscription Management: You can modify, switch, or cancel your auto-renewing subscriptions at any time through your Apple ID or Google Play account settings.
- Renewal Terms: To avoid billing for the subsequent cycle, you must cancel your subscription within your device account settings at least 24 hours before your current billing period ends.
- Grace Periods & Disruption: If a renewal payment fails, your access to premium features may be immediately suspended or reverted to the free tier until a valid payment method is processed by the respective app store platform.
3. Refund Policy
All subscription payments, transactions, and refunds are managed strictly by the respective platform policies of Apple and Google. We cannot directly process or issue refunds. To request a refund, you must submit a claim directly through your Apple App Store or Google Play Store account portal.
4. CRITICAL DISCLAIMER: Not for Emergency Use
THE APP IS PROVIDED FOR INFORMATIONAL USE AND SITUATIONAL AWARENESS ONLY. DO NOT USE THE APP FOR EMERGENCY RESPONSE, LIFE-SAFETY CRITICAL DECISIONS, OR AS A SUBSTITUTE FOR CALLING OFFICIAL EMERGENCY SERVICES (SUCH AS 911).
- No Official Affiliation: The App is an independent, third-party application. It is NOT affiliated with, endorsed by, sponsored by, or connected to any municipal fire department, public safety agency, or government entity.
- Data Source: Incident information is sourced from the City of Phoenix Fire Department's publicly available active-incidents data feed: https://maps.phoenix.gov/phxfire/rest/services/Active_Incidents__Public/MapServer. Cactus Watch does not represent a government entity.
- Data Feeds & Information Limitations: The data displayed in this App is aggregated from public sources. Not all incidents are shown. Data feeds are subject to lag, network drops, or total service interruptions. If the data feed goes down, experiences downtime, or terminates completely, we are not responsible or liable for any missing information, delayed notifications, or resulting damages.
- No Scene Interference: Users are solely responsible for their actions and agree not to use the App or its data, maps, notifications, or other features to access, approach, monitor, or travel to active emergency incidents. Users also agree not to block public roadways, obstruct emergency vehicles, interfere with first responders or public safety personnel, or otherwise disrupt emergency operations in any manner.
5. Intellectual Property
We retain all rights, titles, and interests in the App’s layout design, user interface components, custom imagery, configuration icons, and software code. Interactive maps and satellite layers utilized inside the App are provided by third-party mapping APIs, and we claim no ownership over their underlying imagery or map tiles.
6. Acceptable Use Restrictions
You agree to use the App purely as a passive viewer for lawful purposes. You are strictly prohibited from:
- Using automated scrapers, data-mining bots, or network capture tools to extract data streams from the App infrastructure.
- Attempting to reverse engineer, decompile, mirror, or intercept traffic from our backend data relays.
7. Termination of Access
We may suspend, restrict, or terminate your access to the App at any time, with or without notice, for violations of these Terms or for operational, security, legal, or business reasons.
8. Limitation of Liability and “As-Is” Warranty
The App is provided on an “As Is” and “As Available” basis without warranties of any kind, either express or implied. To the maximum extent permitted by law, we explicitly disclaim any liability for:
- The precision, completeness, operational uptime, or reliability of any data, notifications, or mapping pins.
- Any physical injuries, vehicular citations, property damages, or legal consequences resulting from your physical presence near emergency locations.
- Any direct, indirect, incidental, or consequential damages resulting from app downtime, software bugs, or upstream feed outages.
9. Governing Law and Dispute Resolution
These Terms and any issues arising out of your usage of the App will be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles. Any legal action or dispute arising under these Terms shall be resolved exclusively through binding arbitration in the State of Arizona, and you waive your right to participate in a class-action lawsuit.
10. Age Restrictions
By using the App, you warrant that you meet the minimum age requirements specified by the Apple App Store or Google Play Store age rating for this App. The content displays real-world public emergency logs, which may not be suitable for young children. If you are under the age of majority in your jurisdiction, you represent that you have reviewed these Terms with a parent or legal guardian.
11. Changes to Terms
We reserve the right to update or modify these Terms at any time. When updates occur, we will revise the “Effective Date” at the top of this page. Your continued use of the App after a revision constitutes your formal acceptance of the updated Terms.
