The single most important term. Cactus Watch is for situational awareness only. It is not an emergency response tool, an early-warning system, or a replacement for 911. Data may be delayed, incomplete, or wrong. If you have an emergency, call 911. Do not rely on Cactus Watch to make safety-critical decisions.
By using the Cactus Watch app or this website, you agree to these terms. If you don't agree, don't use the service. We can update these terms; if we do, we'll bump the date above. Continued use after a change means you accept the change.
The free tier is identical to today's offering: refresh-rate-limited, no map, no custom alerts. The paid tier is a recurring monthly subscription billed through Apple's App Store, Google Play, or a web payment processor. You can cancel any time from your platform's subscription settings. We do not offer prorated refunds, but if you cancel, you keep paid access through the end of the billing period.
The Cactus Watch name, logo, app interface, and original code are ours. Phoenix Fire incident data is the City of Phoenix's, used under their Open Data Policy. You may not copy, redistribute, or sell our app or its UI without permission, but you are welcome to reference Cactus Watch in articles, social media, or reviews.
The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement. Public-safety data has inherent inaccuracies and timing gaps. We do our best; we make no promises.
To the maximum extent permitted by law, Cactus Watch and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of property, injury, death, or any harm arising from action or inaction taken in reliance on data shown in the app. Total liability for any direct claim is capped at the amount you paid us in the prior 12 months, or $10 if you have not paid us anything.
These terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Maricopa County, Arizona.
You may stop using the service any time. We may suspend or terminate your access if you violate these terms. We will give reasonable notice unless the violation is severe (for example, abuse threatening service availability for other users).
