Terms of Service

What you're agreeing to

By using the Cactus Watch app or this website, you agree to these terms. If you don't agree, don't use the service. We can update these terms; if we do, we'll bump the date above. Continued use after a change means you accept the change.

What we provide

• A read-only feed of fire and EMS incidents reported on the City of Phoenix Fire Department's public dashboard.
• A polished mobile app and web interface to view that feed.
• (When paid tier launches) faster refresh, custom proximity alerts, and incident history.

What we do not provide

• Emergency notifications. We are not in the dispatch chain.
• A guarantee of accuracy. We re-publish what Phoenix publishes; if their feed is wrong, ours is wrong.
• A guarantee of availability. The service may go down for maintenance, or because Phoenix's source feed went down. No SLA.
• Affiliation with the City of Phoenix or its Fire Department. We are an independent third party operating under Phoenix's Open Data Policy.

Acceptable use

• Personal, non-commercial situational awareness is welcome.
• Don't scrape the API to build a competing service. Use the JSON we publish for your own consumption only.
• Don't reverse-engineer the iOS or Android app to bypass rate limits or paid features.
• Don't use Cactus Watch to interfere with emergency response, harass first responders, or contact the people whose addresses appear in the feed.
• Don't use the service for any unlawful purpose under United States or Arizona law.

Subscriptions (when paid tier launches)

The free tier is identical to today's offering: refresh-rate-limited, no map, no custom alerts. The paid tier is a recurring monthly subscription billed through Apple's App Store, Google Play, or a web payment processor. You can cancel any time from your platform's subscription settings. We do not offer prorated refunds, but if you cancel, you keep paid access through the end of the billing period.

Intellectual property

The Cactus Watch name, logo, app interface, and original code are ours. Phoenix Fire incident data is the City of Phoenix's, used under their Open Data Policy. You may not copy, redistribute, or sell our app or its UI without permission, but you are welcome to reference Cactus Watch in articles, social media, or reviews.

Disclaimer of warranties

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement. Public-safety data has inherent inaccuracies and timing gaps. We do our best; we make no promises.

Limitation of liability

To the maximum extent permitted by law, Cactus Watch and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of property, injury, death, or any harm arising from action or inaction taken in reliance on data shown in the app. Total liability for any direct claim is capped at the amount you paid us in the prior 12 months, or $10 if you have not paid us anything.

Governing law

These terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Maricopa County, Arizona.

Termination

You may stop using the service any time. We may suspend or terminate your access if you violate these terms. We will give reasonable notice unless the violation is severe (for example, abuse threatening service availability for other users).
